TowBuddy Refund Policy, Payment Terms & Disclaimer

TowBuddy is an online marketplace and aggregator that connects customers requiring vehicle towing services with independent towing companies.

TowBuddy does not own, operate, manage, or control any towing vehicles and is not a provider of towing services. All towing services are performed solely by independent towing partners.

To confirm a towing request, customers are required to pay an advance booking amount equal to 20% of the total estimated towing charges through the TowBuddy platform.

Upon successful payment:

• TowBuddy will begin locating a suitable towing partner.
• A towing vehicle will normally be confirmed within 15 minutes of receiving the booking request.
• Confirmation is subject to availability of towing partners.

After completion of the towing service:

• The customer shall pay the remaining 80% balance amount directly to the towing company or through the payment method specified by TowBuddy.
• Any toll charges, parking charges, highway fees, entry taxes, or other government levies incurred during transportation shall be borne entirely by the customer unless otherwise agreed in writing.

Eligible for Refund

The customer may request a 100% refund of the advance booking amount if:

• A towing vehicle is not dispatched or does not arrive within 60 minutes from the confirmed booking time; and the customer chooses to cancel the booking before the towing vehicle reaches the pickup location.

Refunds, where applicable, will be processed within 5–7 business days to the original payment method.

No Refund

The advance booking amount shall not be refunded under the following circumstances:

• The towing vehicle has already reached the pickup location.
• The customer cancels after the towing partner has arrived.
• The customer refuses service after the towing vehicle reaches the pickup point.
• Incorrect pickup location or contact details were provided by the customer.
• The towing partner is unable to locate the customer after reasonable attempts.
• Delays caused by the customer.

Estimated arrival times are provided for guidance only.

Actual arrival times may vary due to:

• Traffic conditions
• Road closures
• Weather conditions
• Vehicle breakdown
• Natural disasters
• Government restrictions
• Public events
• Accidents
• Other circumstances beyond reasonable control

TowBuddy does not guarantee exact arrival times.

All towing operations are carried out solely by the independent towing company selected for the booking.

If any vehicle damage, mechanical failure, loss, theft, delay, accident, or other issue occurs during loading, transportation, unloading, or handling of the vehicle:

• The towing company shall be solely responsible.
• Any compensation claim shall be made directly against the towing company.
• TowBuddy shall not be liable for any such claims.

TowBuddy acts only as a technology platform facilitating the connection between customers and independent towing companies.

TowBuddy shall not be responsible or liable for:

• Damage to vehicles
• Mechanical failures
• Accidents
• Personal injury
• Death
• Theft
• Loss of belongings
• Delay in arrival
• Delay in delivery
• Towing quality
• Driver conduct
• Miscommunication
• Route selection
• Vehicle handling
• Cancellation by towing company
• Cancellation by customer
• Payment disputes
• Cash payment disputes
• Digital payment disputes
• Fraud committed by either party
• Service quality
• Any indirect, incidental, consequential, punitive, or special damages.

TowBuddy is not a party to any payment dispute between:

• Customer and towing company
• Towing company and customer

Any disagreement regarding:

• Final towing charges
• Additional distance
• Waiting charges
• Toll charges
• Parking fees
• Highway charges
• Damage claims

shall be resolved directly between the customer and the towing company.

All towing partners available on TowBuddy are independent businesses.

Nothing contained on the TowBuddy platform shall be interpreted as creating:

• Employer-employee relationship
• Agency
• Partnership
• Joint venture

between TowBuddy and any towing partner.

Customers agree to:

• Provide accurate pickup location.
• Provide correct vehicle details.
• Ensure legal ownership or authorization to tow the vehicle.
• Remove valuable belongings before towing.
• Be present at pickup unless otherwise arranged.
• Pay all agreed charges and applicable tolls.

TowBuddy shall not be liable for delays or inability to provide services due to circumstances beyond its reasonable control, including but not limited to:

• Floods
• Earthquakes
• Cyclones
• Fire
• Pandemic
• War
• Government restrictions
• Civil unrest
• Internet outages
• Power failures
• Traffic congestion
• Vehicle breakdowns
• Acts of God

To the maximum extent permitted by applicable law:

• TowBuddy's liability, if any, shall be limited only to refunding the advance booking amount where applicable under this policy.
• Under no circumstances shall TowBuddy be liable for any indirect, consequential, exemplary, incidental, or punitive damages.

TowBuddy reserves the right to modify, amend, or update this Refund Policy, Payment Terms & Disclaimer at any time without prior notice. Continued use of the platform constitutes acceptance of the updated policy.
